zannî meselelerde bilmeyen kimsenin ehl-i ilme başvurmasının meşruiyeti, taklit ve bilgi arasındaki

Principles of Islamic Jurisprudence (Usūl al-Fiqh) is one of the fundamental Islamic disciplines that
enables the resolution of new issues—arising after the completion of the revelation process—within the
framework of legal proofs and the hierarchy among them. The primary function of this science is to
systematically elucidate the sources of divine rulings, the methods of deriving rulings from these
sources, and the underlying principles upon which rulings rest. In this respect, Usūl al-Fiqh is not merely
a discipline that transmits jurisprudence produced in the past, but rather a methodological science that
provides the capacity to generate Islamic legal solutions for emerging problems in the face of changing
conditions.
The purpose of this paper is to examine the function of the principles of Islamic jurisprudence (usūl al-
fiqh) within the framework of the concepts of ijtihād and taqlīd, and to demonstrate the role of legal
methodology in resolving modern problems. The study will first address the function of usūl al-fiqh in
the derivation of legal rulings (istinbāṭ), and subsequently evaluate the distinctions between the domain
of speculative knowledge (zannī) and that of rational judgments and mutawātir information that yield
decisive knowledge. The insufficiency of taqlīd in rational and creedal matters, such as the existence
and oneness of Allah, alongside the legitimacy of non-experts consulting scholars in specialized,
speculative issues, necessitates a multi-layered analysis of the relationship between imitation (taqlīd)
and knowledge.
The methodology of this study is based on a comparative and analytical evaluation of classical
jurisprudence theory and contemporary literature on usūl al-fiqh. In this context, the principle 'Ask the
people of knowledge if you do not know' (An-Nahl 16:43) will be addressed in terms of expertise,
knowledge sharing, and scholarly authority. Furthermore, the acquisition of knowledge as a communal
obligation (farḍ al-kifāyah) will be evaluated in light of the necessity for scholarly specialization within
society.
In conclusion, this paper argues that the new issues emerging today in fields such as biotechnology,
artificial intelligence, digital finance, crypto-assets, medicine, and family law pose significant
challenges for legally responsible persons (mukallafs) when examined from the perspective of religious
rulings. It concludes that, in addressing these issues, mukallafs should consult the knowledge and
expertise of religious scholars and theologians who conduct research in these fields in order to learn the
relevant religious rulings, taking into consideration the Qur’an, Sunnah, ijmāʿ, qiyās, and other uṣūl-
based methods, as well as the objectives of the law (maqāṣid), the effective causes (ʿilal), and the
hierarchy of legal proofs (adillah).

It is further concluded that when scholars conducting research in these fields employ the dynamic nature
of uṣūl al-fiqh and arrive at religious rulings, mukallafs act in accordance with these rulings by following
and relying upon the legal judgments (taqlīd) of qualified religious scholars.
